Terms of Service

Your agreement with Elite Rehab Physical Therapy for the use of MotionDoc: what the software is, what it is not, what you are responsible for, and how subscriptions work.

1. This agreement

These Terms govern your use of MotionDoc, the software application provided by Elite Rehab Physical Therapy ("we", "us"), operated from Thiruvananthapuram, Kerala, India. MotionDoc is a product of Elite Rehab Physical Therapy; in these Terms "MotionDoc" means the application and "we" means the company that provides it. By creating an account, or by ticking the agreement box during setup, you accept these Terms. If you do not accept them, do not use the software.

MotionDoc is offered to qualified physiotherapists and the clinics they work in. You must be legally entitled to practise, and to keep health records, in the place where you practise. It is not offered to members of the public for their own health records.

MotionDoc is operated from India and may be used by clinicians internationally. These Terms are governed by Indian law, as set out in section 11 — but a governing-law clause does not remove rights that the law of your own country gives you and does not allow to be contracted away. Where your local law grants you mandatory consumer or data-protection rights, those rights continue to apply, and nothing here is intended to limit them.

2. What MotionDoc is — and is not

MotionDoc is a documentation and workflow tool. It helps you record consultations, structure notes, keep assessments and measurements, plan treatment, share home programmes with patients, and run the administrative side of a physiotherapy practice.

MotionDoc does not diagnose, does not treat, and does not make clinical decisions. It is not marketed or certified as a medical device, and it must not be used as one. Nothing it produces — including anything produced with AI assistance — is medical advice, a diagnosis, or a treatment recommendation on which you may rely without your own judgement.

3. AI features and your review obligation

Some MotionDoc features use AI: transcribing consultation audio, structuring a transcript into a SOAP note, suggesting treatment options, summarising published research, and generating exercise progressions. These features are optional. They run only after you have given AI consent, and you can withdraw that consent at any time in Settings → AI.

AI output is a draft. Language models can be wrong, can omit something that was said, and can produce text that reads confidently while being inaccurate. You must read and correct every AI-generated field before saving it into a patient record or acting on it. The record you save is your record, authored by you.

  • Review every AI-drafted note, impression and plan before saving it.
  • Check any research summary against the cited source before it changes what you do with a patient.
  • Remember that a transcript is sent as spoken. Edit out anything that should not leave your device before generating a note — the transcript box exists for exactly that.
  • Do not use AI features for a patient who has not consented to their consultation being recorded and transcribed.

4. Your responsibilities

You are responsible for how MotionDoc is used under your account and inside your workspace.

  • Keep your account secure. Do not share your sign-in, and use the app lock on any shared or unattended device.
  • Obtain each patient’s consent before recording, transcribing or keeping a record of their care, and give them the plain-language terms MotionDoc presents for that purpose.
  • Only enter information you are entitled to process. Do not put a person’s health information into MotionDoc if you have no lawful basis or professional relationship that permits it.
  • Keep the information you enter accurate, and correct it when it turns out not to be.
  • Treat patient-facing plan links as credentials. Anyone holding one can open what it shows, so send them to the patient and revoke a link that goes astray.
  • Comply with the professional, record-keeping and data-protection rules that apply where you practise. Those obligations are yours; MotionDoc is a tool you use to meet them.
  • Do not attempt to access another workspace’s data, probe or disrupt the service, or resell access to it.

5. Your data and your patients’ data

The clinical records you create are yours and your patients’. We do not sell them, we do not share them for advertising, and we do not use them to train AI models. We process them to run the service for you, as described in the Privacy Policy, which forms part of these Terms.

You can export a full backup at any time from Settings → Data. You can ask us to delete your account from the same screen. Deletion hides your records immediately and permanently erases the account, its workspace and its clinical records from our database after a grace period; the Privacy Policy sets out the grace period and the two categories of data that deliberately survive it.

6. Plans, trials and payment

MotionDoc offers free and paid plans. Paid plans are billed through Razorpay, our payment processor; we do not receive or store your card details. Prices are shown in the app before you buy, in the currency resolved for your region, and the price charged is the one the server quotes at checkout.

You can cancel from Settings → Billing at any time. Cancelling at the end of the period leaves your subscription active until the period you have paid for runs out; cancelling immediately ends access straight away. You can also pause and resume a subscription. Downgrading takes effect as described at the point you request it.

A free trial is available once per email address. We keep a one-way, irreversible fingerprint of the address used, so that the same address cannot claim repeated trials; that fingerprint cannot be turned back into an address and survives account deletion for this reason alone.

7. Beta and early-access features

MotionDoc is running a Founder Beta, and parts of the product are offered as beta or early-access features. Beta functionality is provided as it is, to help us learn what clinicians actually need.

  • Beta features can change, move or be withdrawn, and behaviour during a beta may not represent the final product.
  • Beta features may contain defects. Availability and performance may vary.
  • We may ask for your feedback, and you are free to decline. If you send us feedback, we may use it to improve MotionDoc without owing you anything for it.
  • Beta access may be granted for a limited period and may end when that period does.
  • Your clinical records are not beta. They are handled exactly as the Privacy Policy describes whether or not a beta feature produced them.

8. Availability and changes

We work to keep MotionDoc available and correct, but we do not promise uninterrupted service. Maintenance, provider outages, network problems and defects all happen. MotionDoc is built offline-first precisely so that a service interruption does not stop you seeing a patient: the app keeps working on your device and syncs when it can.

We may change these Terms as the product changes. When a change is material we will tell you in the app before it takes effect. If you keep using MotionDoc after that, the updated Terms apply. If you do not accept them, you may stop using the service and delete your account.

9. Liability

MotionDoc is a documentation tool used by a qualified professional who remains responsible for clinical decisions. We are not liable for clinical outcomes, for decisions you take, or for the content of records you author — including where an AI feature produced a draft you then saved.

For everything else, and to the extent the law allows, our total liability to you for any claim connected with MotionDoc is limited to the amount you paid us for the service in the twelve months before the claim arose. We do not exclude or limit liability where it would be unlawful to do so — including for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under the law that applies to this agreement.

You are responsible for keeping your own professional indemnity arrangements in place. MotionDoc is not a substitute for them.

10. Ending this agreement

You may stop using MotionDoc at any time, and delete your account from Settings → Data. Export a backup first if you need to keep your records — after the grace period described in the Privacy Policy, we cannot recover them.

We may suspend or end access if these Terms are seriously or repeatedly broken — for example an attempt to reach another workspace’s data. Where it is reasonable to do so we will warn you first and give you a chance to export your records.

11. Governing law and contact

This agreement is governed by the laws of India, and the parties submit to the courts of competent jurisdiction in Kerala, India.

That choice is the default, not an override. If you use MotionDoc from outside India, any right your own law gives you that cannot be excluded by agreement — consumer protections, data-protection rights, or a right to bring a claim locally — is unaffected by the paragraph above. We are not asking you to give those up, and this clause should not be read as though you had.
